1. Acceptance of Terms

By accessing or using SmartImgKit, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Description of Service

SmartImgKit provides free online image processing tools that operate entirely within your web browser. All processing is client-side; we do not store or transmit your images.

3. User Responsibilities

You agree to use SmartImgKit only for lawful purposes. You are solely responsible for the images you process and the results you produce. Do not use our tools to create or distribute illegal, infringing, or harmful content.

4. Intellectual Property

SmartImgKit does not claim ownership of any images you process. You retain all rights to your original content. The output images generated by our tools are yours to use as you see fit. SmartImgKit retains all rights to the website design, code, and branding.

5. DMCA Copyright Policy

SmartImgKit respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding copyright infringement claims.

5.1 DMCA Notification (Copyright Infringement Claim)

If you believe that your copyrighted work has been copied and is accessible on or through SmartImgKit in a way that constitutes copyright infringement, please submit a written notification to our Copyright Agent with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material that is claimed to be infringing, including information reasonably sufficient to allow us to locate the material (URL or specific description);
• Your contact information, including address, telephone number, and email address;
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
• A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

5.2 Counter-Notification

If you believe that material identified in a DMCA notification was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent with the following:

• Your physical or electronic signature;
• Identification of the material that has been removed or disabled, and the location where it appeared before removal;
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
• Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which SmartImgKit may be found.

5.3 Repeat Infringer Policy

SmartImgKit maintains a policy of terminating, in appropriate circumstances, the accounts or access rights of users who are repeat infringers of copyright. We may also, at our sole discretion, limit access to the service and/or terminate the accounts of any users who infringe the intellectual property rights of others.

5.4 DMCA Agent Contact

DMCA notifications and counter-notifications should be sent to our designated Copyright Agent at: copyright@smartimgkit.com. Please note that under federal law, intentionally materially misrepresenting that material or activity is infringing may subject you to liability for damages, court costs, and attorneys' fees.

6. No Warranty

SmartImgKit is provided "as is" without any warranties, express or implied. We do not guarantee that our tools will meet your requirements, be error-free, or produce specific results. Use at your own risk.

7. Limitation of Liability

In no event shall SmartImgKit or its operators be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use our services.

8. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of any third-party sites.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of SmartImgKit after changes constitutes acceptance of the new Terms.

10. Termination

We reserve the right to terminate or suspend your access to SmartImgKit, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use SmartImgKit will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and liability limitations.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of SmartImgKit shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the competent court located in Beijing, China. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
